Customer upset about seam through sink.

What's wrong with small claims court. Used it myself... easy, inexpensive and successful.

Ken is correct, although those procedures are usually sales and customer qualifying related rather than contractual. You've got to sniff these types out beforehand, unfortunately it takes a lot of "tuition" before you can.Ken Lago wrote:It sucks but there is procedures you can set up so it doesn't happen again in the future.
The state of Florida, where I am a licensed Building contractor, has made the contracts of unlicensed contractors unenforceable in court. You could build a perfect addition to a home but if you're unlicensed you can't legally collect a thing, however, the homeowner may enforce the contract on you.

It shouldn't really matter, in court, if you have a contract or not - they aren't arguing that you agreed to do the job for free, right? Take the MIA manual to court and show that a seam through the sink is acceptable and you should have a good ruling in court... *fingers crossed*BlueFlower wrote:Thank you for all of your responses.
Long story short, I believe these people are con artist's. We did their cabinets as well. When we tor out their previous cabinets, we had to move their stove, (not our responsibility). We accidentally broke the glass on the door. Keep in mind this stove is about 30-40 years old valued at $150-200 tops.
We made a verbal agreement with the husband to pay for half of a new stove or pay them $400. The wife later says we half to buy them a $900 stove and we are lucky because she wanted a $1500 one.
The seam is their excuse to not have to pay the $11000 bill for the flooring, rest of cabinets as well as granite bill.
Somehow our secretary missed having them sign our contract.
However, we talked to our lawyer and he has informed us that there is nothing we could have done anyway because there is a department of L and I disclosure agreement that has to be signed along with our contract for their to be valid recourse.
We are in the process of talking to other lawyers but it's not looking like we will be able to collect outside of small claims court.
I was just in court last week because of a similar situation and actually got another $1600 I wasn't planning on. ..
