SUED BY SILESTONE DISTRIBUTOR for name ??

Waterloo Stone Works Inc is a family owned business operating in Southern Ontario , http://www.coronadocorp.com
we are being sued by the firm at 16 Nixon Road Bolton that operates and distributes SILESTONE (INTERNATIONAL LOGISTICS AND STONE DISTRIBUTION )products in Canada , not surprisingly from the same address 16 Nixon Road in Bolton where they also fabricate for Home Depot and operate at the same address and share phone no's with MAPLE TERRAZO MARBLE AND TILE INC , they also operate Stoneworks Marble & Tile from the same address , after being made aware of an action in the Federal Trademark Court as a patent infringement lawsuit against a fellow fabricator that was using the name Stone Works , but had not registered it I felt this was not my business . Wrong ! , this firm is going after everyone that uses Stone Works ,(landscapers included) even though they have patented "STONEWORX" recently I had purchased approximately 40 slabs of SILESTONE , the ink was not dry on the check when I received notice of the court action . I then contacted all of the people listed in other actions about 6 of us little guys and they had all bought a SILESTONE product from INTERNATIONAL LOGISTICS AND STONE DISTRIBUTION in the weeks and months prior, do you believe in coincidence . I do not
I contacted SILESTONE aka Consentino in Texas and relayed my concerns , no reply , i had spoken to their legal department , again no reply
I am of the opinion that there is no coincidence , the firm involved in this frivolous action because of their size to control a name in the market is using purchasers of SILESTONE as their data base to harm us and to control a market , because they think they can
I have reviewed the post by Ken Lauzon and agree with and I am in the same position as he is.
I would look forward to working with anyone that may be able to offer suggestions as to how we can end this corporate bullying

Nice posting Rick, going public with this is the best way to make them open their eyes. They have never actually won a case as none of the law suits have actually made it to a court room. These people are very good at this.

I think the 6 of you need to get together and figure out the best and most efficient way to collectively fight this. Even if you all do not know eachother or are competitors, it would make sense to join together to lessen expenses and be a more powerful defense to the suit.


I would think that at least one of you has had the legal name longer than the suing company, FWIW that may be of legal help.

Rick are you saying that you think the fact that you bought a container of Silestone from these guys is what made you show up on their radar? That's doubly nuts if thats the case! You can't make this stuff up!

I am so sorry that you've had to go through this. This looks to me like one of the worst case of corporate bullying that I've ever heard of. THIS IS A SILESTONE DISTRIBUTOR AND THEY ARE SUING SILESTONE CUSTOMERS. That is the craziest business plan that I've ever seen.

It will make me think twice about buying Silestone! Or three or four times. I need to go look at how much Silestone I sell. I don't want to be sued by one of their distributors that has copyrighted "Countertopz" or something like that.
